CVoyager Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the CVoyager mobile application, related features, subscriptions, map layers, route planning tools, navigation warning information, downloadable or exportable route files, and any related services provided by Vladyslav Yarmak/ Salt Water Soft (“we”, “us”, or “our”).

By downloading, accessing, purchasing, subscribing to, or using CVoyager, you agree to these Terms. If you do not agree to these Terms, do not use the app.

1. About CVoyager

CVoyager is a maritime planning and information application. The app may include features such as route planning, route editing, route export, map layers, maritime zones, navigational warnings, NAVAREA warnings, coastal warnings, Canadian NAVWARNs, oil rig / MODU information, ports information, and other maritime-related content.

CVoyager is designed as an aid for planning and situational awareness only. It is not an official navigation system, electronic chart display and information system, certified ECDIS, official nautical chart, official Notice to Mariners source, or replacement for professional maritime judgment.

2. Important Maritime Safety Notice

You must not rely on CVoyager as your only source of navigation, safety, weather, route, warning, or voyage information.

Before and during any voyage, you are responsible for checking official and up-to-date sources, including but not limited to official nautical charts, Notices to Mariners, NAVAREA warnings, coastal warnings, local authority warnings, radio broadcasts, vessel traffic services, pilotage requirements, port authority instructions, weather forecasts, and all other applicable maritime regulations and safety information.

Maritime data can be delayed, incomplete, inaccurate, unavailable, or changed without notice. Routes, warnings, overlays, zones, distances, courses, ports, and other information displayed in CVoyager may contain errors or may not reflect the latest real-world conditions.

You are solely responsible for the safe navigation and operation of any vessel. CVoyager must be used only as an additional planning and reference tool.

3. Eligibility and User Responsibility

You may use CVoyager only if you are legally allowed to use the app in your country or region and you agree to comply with these Terms.

You are responsible for:

• using the app safely and lawfully;

• verifying all information with official sources;

• maintaining proper watchkeeping and navigation practices;

• ensuring that your device, internet connection, GPS, operating system, and app version are suitable for your intended use;

• complying with maritime laws, port regulations, traffic separation schemes, reporting requirements, environmental zones, security zones, and other applicable rules.

4. App Content and Data Sources

CVoyager may display information from third-party sources, public data sources, maritime information providers, official or semi-official sources, mapping providers, and other external services.

We do our best to provide useful and reliable information, but we do not guarantee that any data in the app is complete, current, accurate, available, suitable for navigation, or free from errors.

Some information may require an internet connection. If your device is offline, has poor connectivity, or if a third-party service is unavailable, some app features may not work correctly.

5. Subscriptions and Paid Features

CVoyager may offer paid features, one-time purchases, and auto-renewing subscriptions.

A subscription may provide access to features such as live or regularly updated maritime warnings, NAVAREA warnings, coastal warnings, Canadian NAVWARNs, oil rig / MODU information, and other subscription-based content shown in the app at the time of purchase.

The exact subscription name, price, duration, billing period, trial period, included features, and availability will be shown on the purchase screen before you confirm your purchase.

6. Auto-Renewing Subscriptions

If you purchase an auto-renewing subscription, your subscription will automatically renew at the end of each billing period unless you cancel it before renewal according to the rules of the platform where you purchased it.

Payment will be charged through the app store account used to make the purchase, such as your Apple ID or Google Play account.

The subscription price and billing period will be shown before purchase. Prices may vary by country, region, currency, taxes, app store pricing rules, and promotional offers.

7. Free Trials and Introductory Offers

CVoyager may offer a free trial, introductory price, promotional offer, or other limited-time subscription offer.

If a free trial or introductory offer is available, the app will show the duration of the offer, the subscription price after the offer ends, the billing frequency, and how to cancel before being charged.

Unless you cancel before the trial or introductory offer ends, your subscription may automatically convert into a paid subscription and your app store account may be charged according to the subscription terms shown at the time of purchase.

Free trials and introductory offers may be available only to eligible users and may vary by country, platform, app store account, or subscription history.

8. Managing and Cancelling Subscriptions

You can manage or cancel your subscription through the app store account used to purchase it.

For subscriptions purchased through Apple, manage or cancel the subscription in your Apple ID subscription settings.

For subscriptions purchased through Google Play, manage or cancel the subscription in Google Play subscriptions.

Deleting the CVoyager app does not automatically cancel your subscription. You must cancel the subscription through Apple, Google Play, or the platform where you purchased it.

If you cancel your subscription, you will normally continue to have access to the subscribed features until the end of the current billing period, unless the app store rules or applicable law provide otherwise.

9. Refunds

Payments, refunds, cancellations, and billing issues are handled by the platform where the purchase was made, such as Apple App Store or Google Play.

We do not directly process app store payments and may not be able to issue refunds for purchases made through Apple or Google Play. Refund eligibility is determined by the applicable app store policies and applicable law.

10. Price Changes and Subscription Changes

Subscription prices, included features, billing periods, trial offers, and availability may change from time to time.

If required by the applicable app store or by law, you will be notified of price changes before they take effect. You may need to accept certain price changes to continue the subscription. If you do not accept a required price change, your subscription may end.

We may add, modify, or remove subscription features, but we will not intentionally remove the core recurring value of an active subscription without appropriate notice where required.

11. Existing Purchases

If CVoyager offers both one-time purchases and subscriptions, each purchase provides only the access described at the time of purchase.

If you previously purchased a one-time feature, such as premium ports or another non-consumable feature, that purchase remains subject to the terms that applied to that feature. A new subscription does not automatically replace or cancel your existing one-time purchase unless clearly stated.

12. Account, Device, and Access Limitations

Subscription access may depend on the app store account, platform, device, operating system, internet connection, region, and availability of third-party services.

Access may not transfer between Apple App Store and Google Play unless we explicitly provide cross-platform account support.

Some features may not be available in all countries, regions, languages, devices, or platforms.

13. Route Planning, Exports, and User Data

CVoyager may allow you to create, edit, save, import, or export routes and voyage-related information.

You are responsible for reviewing, verifying, and safely using any route or data created, modified, imported, or exported through the app.

Exported files, including but not limited to CSV, RTZ, or other formats, must be checked carefully before use in any other software, device, navigation system, or onboard equipment. Compatibility with third-party systems is not guaranteed.

14. Updates and Changes to the App

We may update, modify, suspend, or discontinue any part of CVoyager at any time. Updates may be required for security, compatibility, legal compliance, app store requirements, third-party service changes, data source changes, or feature improvements.

Some features may stop working if you do not install the latest version of the app.

15. Acceptable Use

You agree not to:

• misuse the app or use it for unlawful purposes;

• copy, modify, reverse engineer, decompile, or attempt to extract the source code of the app except where permitted by law;

• interfere with the app, servers, subscriptions, purchases, security systems, or third-party services;

• attempt to bypass paid features, subscription checks, or app store payment systems;

• use the app in a way that could endanger people, vessels, property, or the environment;

• reproduce, redistribute, resell, or commercially exploit app content unless we give written permission.

16. Intellectual Property

CVoyager, including its design, software, interface, graphics, route tools, app structure, branding, and original content, is owned by Vladyslav Yarmak/ Salt Water Soft or its licensors and is protected by intellectual property laws.

These Terms do not give you ownership of the app or its content. You receive only a limited, personal, non-exclusive, non-transferable, revocable license to use the app according to these Terms and the rules of the app store where you downloaded it.

17. Third-Party Services

CVoyager may use or link to third-party services, including mapping providers, data providers, app store payment systems, maritime information sources, analytics tools, or other services.

We are not responsible for third-party services, their availability, accuracy, terms, policies, or content. Your use of third-party services may be governed by their own terms and privacy policies.

18. Privacy

Your use of CVoyager is also governed by our Privacy Policy, available at:

The Privacy Policy explains what data may be collected, how it is used, how it is stored, and what choices you may have.

19. No Warranty

CVoyager is provided “as is” and “as available.”

To the maximum extent permitted by law, we make no warranties, express or implied, about the app, including but not limited to warranties of accuracy, reliability, availability, fitness for a particular purpose, merchantability, non-infringement, or suitability for navigation.

We do not guarantee that the app will be uninterrupted, error-free, fully accurate, always updated, or available in all locations.

20. Limitation of Liability

To the maximum extent permitted by law, Vladyslav Yarmak/ Salt Water Soft shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of or inability to use CVoyager.

This includes, without limitation, damages related to navigation decisions, voyage planning, route errors, incorrect warnings, missing warnings, delayed data, device failure, loss of data, vessel delay, business interruption, loss of profit, injury, property damage, environmental damage, or reliance on app content.

Nothing in these Terms limits liability that cannot be limited under applicable law.

21. Indemnity

You agree to defend, indemnify, and hold harmless Vladyslav Yarmak/ Salt Water Soft from and against any claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the app, violation of these Terms, violation of law, or unsafe reliance on app information.

22. Termination

We may suspend or terminate your access to CVoyager if you violate these Terms, misuse the app, attempt to bypass payment systems, or use the app in a way that creates legal, security, or safety risks.

You may stop using the app at any time. If you have an active subscription, stopping use or deleting the app does not cancel the subscription. You must cancel it through the app store account where it was purchased.

23. Changes to These Terms

We may update these Terms from time to time. When we make changes, we may update the effective date above and, where appropriate, provide notice in the app or through the app store.

Your continued use of CVoyager after the Terms are updated means that you accept the updated Terms.

24. Governing Law

These Terms are governed by the laws of EU, except where applicable consumer protection laws require otherwise.

If you are a consumer, you may have mandatory rights under the laws of your country or region that cannot be limited by these Terms.
